Section 20
Provisions relating to filing of suit:

(1) After completion of the investigation and investigation of the offense under this Act, if it is deemed necessary to file a case, the investigating officer shall submit the evidence and evidence related to the investigation along with his opinion to the relevant public prosecutor's office for a decision on whether or not to proceed with the case.
(2) Related to the receipt of a letter as per sub-section (1) - If the public prosecutor's office does not proceed with the case in the said matter, mentioning the same procedure and the person to be prosecuted and the person to be prosecuted and the indictment, sentence and claim against him in the indictment, if exemption is to be granted in accordance with section 23A. Missile will have to be sent back to the investigating officer.
(3) Regardless of what is written in sub-section (2), if the public prosecutor's office studies the missile received, if it appears that further investigation is required, further investigation should be conducted, the contents must be ascertained and the missile must be sent back to the investigating officer along with the grounds and reasons.
(4) According to sub-section (3), in case of further investigation of a matter, the investigating officer shall submit the report to the public prosecutor's office with the proposed indictment to file a case.
(5) According to sub-section (4) - after receiving the missile, the relevant public prosecutor's office shall send the missile back to the investigation officer after deciding whether or not to proceed with the case according to sub-section (2).
(6) According to sub-section (2) or (5) after the decision to proceed with the case is received from the Public Prosecutor's Office, the investigating officer shall file the case before the investigating officer on behalf of the Government of Nepal within thirty days.
(7)- When filing a case in accordance with this Act, only the sample(s) of the finished goods or dashi shall be submitted. But it is not necessary to submit samples of agricultural produce, goods that have already been sold.
